These terms govern Troxic, a native macOS email and calendar client (“we”, “us”). By installing or using Troxic you agree to them. If you do not agree, do not use the software. Contact: contact@troxic.ch.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Troxic on Macs you control. We retain all rights not expressly granted. You may not sublicense, resell, or redistribute Troxic.
2. What Troxic is
Troxic is client software. It runs on your Mac and talks directly to Google, Microsoft Graph, or the IMAP/SMTP hosts you configure, using credentials you authorize. We do not operate a mail server or a sync service that stores your messages. Troxic is not a backup.
3. Your responsibilities
- You are responsible for the Mac Troxic runs on and for every account you connect. Anyone with access to your unlocked Mac may be able to read the local cache.
- You are responsible for what you send and for complying with your providers' terms and applicable law.
- You may not use Troxic to send unsolicited bulk mail, to harass, or for any unlawful purpose.
- You may not reverse engineer Troxic except to the extent that restriction is unenforceable.
4. Third-party services
Your use of Gmail, Google Calendar, Microsoft 365, IMAP/SMTP, OpenAI, and DFIR Lab remains governed by those providers. We are not affiliated with, endorsed by, or sponsored by Google LLC, Microsoft Corporation, or OpenAI. A provider may change or withdraw API access at any time.
Optional AI and phishing checks run only when you ask, under keys you supply, as described in the Privacy Policy. These terms do not state how long DFIR Lab keeps a submitted message. Write to contact@troxic.ch if you need that answer.
5. Privacy
The Privacy Policy is part of these terms. Troxic's use of Google user data adheres to the Google API Services User Data Policy, including Limited Use.
6. Fees
Troxic is currently provided free of charge during closed testing. If we introduce paid plans we will give at least 30 days' notice in the application before any charge applies.
7. Updates
Troxic does not currently ship an auto-updater. When we do, updates may add, change, or remove features. Older builds may stop working if a provider changes its APIs.
8. Disclaimer
Troxic is provided “as is” and “as available”, without warranty of any kind, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Troxic will be uninterrupted or that it will deliver, send, or preserve any particular message. Do not rely on Troxic as your only copy of anything.
9. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, profits, or business. Our aggregate liability for any claim relating to Troxic is limited to the greater of the amount you paid us for Troxic in the twelve months preceding the claim, or CHF 100. Nothing here excludes liability that cannot lawfully be excluded.
10. Indemnity
You will indemnify us against claims, damages and reasonable costs arising from your use of Troxic in breach of these terms or of applicable law.
11. Termination
You may stop using Troxic by uninstalling it and revoking access at myaccount.google.com/permissions and myaccount.microsoft.com. We may suspend or terminate the licence if you materially breach these terms. Sections 8 through 13 survive termination.
12. Changes
Material changes will be announced in the application at least 14 days before they take effect. Continuing to use Troxic after that date is acceptance.
13. Governing law
These terms are governed by the substantive law of Switzerland, excluding its conflict-of-law rules and the CISG. The courts of Lugano, Switzerland have exclusive jurisdiction, except that consumers resident in the EU/EEA retain mandatory local protections and may bring proceedings in their own courts.
